GENERAL TERMS OF USE AND CONDITIONS OF SALE

ARTICLE 1 SCOPE AND ACCEPTANCE OF THE TERMS

These Terms apply to any access to and use of the Website, and govern any Orders placed via the Website. Any Customer of the Website is deemed to have accepted the Terms.

ARENAS by Helen Acosta Ltd may amend the Terms at any time by publishing a new version thereof on the Website and any access to and/or use of the Website following such publication shall be governed by such new version of the Terms.

ARENAS by Helen Acosta Ltd may inform Customers who have created a Customer Account about any amendments of the Terms via e-mail, if deemed appropriate at its free discretion.

Customers’ sole remedy if they do not accept any of the amendments is to cancel their Customer Account and stop using the Website.

These general terms and conditions of sale (hereafter “GTCs”) are applicable to the internet site www.arenasbyhelen.com (hereafter “ARENAS by Helen Acosta Online Boutique”), offering the sale of swimwear articles and accessories bearing the “ARENAS by Helen Acosta” trademark (hereafter all together the “Product(s)”).

By ordering and buying Products from the ARENAS by Helen Acosta Online Boutique, the customer (hereafter “Customer”) fully accepts the present GTCs by ticking the relevant acceptance box. These GTCs can be saved and/or printed and are accessible from all the pages of the ARENAS by Helen Acosta Online Boutique. They can be amended at any time and the terms applicable are those accepted by the Customer when placing an order, which can be accessed from the order confirmation email.

THE CUSTOMER

Through the ARENAS by Helen Acosta Online Boutique, ARENAS by Helen Acosta Ltd offers Products for sale to non-trade Customers, in the capacity of consumers, aged over eighteen (18) and with full legal capacity. Products are sold on a retail basis strictly for personal use.

In general, ARENAS by Helen Acosta Ltd reserves the right to refuse any order of Products of an abnormal nature, in particular in the event of orders in quantity and/or for amounts which would be reasonably deemed abnormal by ARENAS by Helen Acosta Ltd.

THE WEBSITE

Subject to these Terms and conditions of Use, ARENAS by Helen Acosta Ltd hereby grants the Consumer a limited, revocable, non-transferable, and non-exclusive license to access and use this Site.

For the avoidance of doubt, as between ARENAS by Helen Acosta Ltd and the Customers, any rights in the Website, its content and in the Brand remain the sole and exclusive property of ARENAS by Helen Acosta Ltd.

The Website and its content are provided by ARENAS by Helen Acosta Ltd for strictly personal use and for the sole purposes of informing Customers about the Products and promoting the Brand, as well as allowing Customers to place Orders.

Any breach of these Terms of Use shall result in the immediate revocation of the license granted in this paragraph without notice to you.

Customers shall not (i) reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted by ARENAS by Helen Acosta Ltd in writing, (ii) not make any commercial use of any of the information provided on the Site or make any use of the Site for the benefit of another business unless explicitly permitted by ARENAS by Helen Acosta Ltd in advance.

In particular, each Customer covenants not to (iii) use the Website for any purposes or in any manner that would contravene any applicable provisions of law or infringe any intellectual property or other rights or legitimate interests of ARENAS by Helen Acosta Ltd or any third party, (iv) provide any untrue, inaccurate or incomplete information to ARENAS by Helen Acosta Ltd, and (v) use any malicious code or program in connection with the Website, with the objective of damaging the Website or interfering with its proper functioning or gaining access to or extracting any content or data therefrom, including Personal Data of other Customers.

ARENAS by Helen Acosta Ltd reserves the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including without limitation, if ARENAS by Helen Acosta Ltd holds that Customer’ conduct violates applicable law, the terms of this agreement, or is harmful to ARENAS by Helen Acosta’ interests.

Customers shall not reproduce, distribute, sell or assign any content of the Website or otherwise use or exploit the Website or its content for any purposes other than those specified above.

ARENAS by Helen Acosta Ltd may change the Website or any part thereof, without notice and with no liability towards the Customers.

CUSTOMER ACCOUNTS AND ORDERS

Customers may create personal Customer Accounts to save certain information such as e-mail, shipping and billing addresses, to remember favourite products, to check pending and past Orders, to subscribe and unsubscribe ARENAS by Helen Acosta Ltd newsletters as well as other functionalities ARENAS by Helen Acosta Ltd may from time to time implement in the Customer Accounts section of the Website.

Customers are solely responsible for choosing a safe password and safekeeping it, to avoid abuse of their Customer Accounts. If Customers suspect any abuse of their Customer Account, he/she shall immediately change the password and inform ARENAS by Helen Acosta Ltd.

Subject to the age condition bellow, Customers may place Orders using their personal Customer Account or as “guests”, in which case they must provide ARENAS by Helen Acosta Ltd at least with a valid and operational e-mail address, a shipping address and, if different from the latter, a billing address.

Customers must be at least 18 years of age and have full legal capacity in order to create and use

a Customer Account and/or to place Orders independently.

Customers who are not 18 years of age or who have restricted legal capacity may do so with the consent of their legal representative.

When a Customer creates a Customer Account and/or each time a Customer places an Order, he/she represents and warrants to ARENAS by Helen Acosta Ltd fulfilling the above criteria.

Customers shall only provide ARENAS by Helen Acosta Ltd with true, accurate and complete information upon which ARENAS by Helen Acosta Ltd and its partners shall fully rely, in particular, for the processing of Orders.

ARENAS by Helen Acosta Ltd and its partners shall have no responsibility or liability whatsoever with respect to the untrue, inaccurate and/or incomplete information provided by Customers and, in particular, shall have no obligation to verify the shipping address when processing an Order.

Any additional costs that may arise in connection with the provision of untrue, inaccurate and/or incomplete information shall be fully born by the relevant Customer.

Orders may only be placed for personal purposes. ARENAS by Helen Acosta Ltd reserves the right to limit the quantity of Products per Customer and/or per Order.

These limits may apply to the Orders placed via the same Customer Account, the same credit card, or using the same billing and/or shipping address.

ARENAS by Helen Acosta Ltd is not obliged to accept any Orders. In particular, ARENAS by Helen Acosta Ltd may reject Orders and/or terminate Customer Accounts by Customers who have failed to comply with any of the provisions of these Terms, in particular, payment obligations, or if it suspects that Orders are placed in view of reselling the Products.

Order process: Customers may check the content of their Basket by clicking on the corresponding icon and may amend such content at any time during the Order process until payment. The Basket expires at the end of a period of twenty (20) minutes without activity on the Website from the Customer.

During the Order process, Customers are guided through different stages by the Website. Until payment, Customers may return to the previous stage at any time.

Customers complete their Orders by confirming their payment.

Once completed, ARENAS by Helen Acosta Ltd Confirms Orders to Customers on the website and by e-mail. Customers are advised to keep such confirmation e-mails. If Customers do not receive a confirmation e-mail from ARENAS by Helen Acosta Ltd upon completion of any Orders, they are advised to contact the ARENAS by Helen Acosta Ltd at the address indicated in Section 12, after verification of their spam inbox.

LANGUAGES

The ARENAS by Helen Acosta Online Boutique is accessible in English and Spanish.

PRODUCTS

The Products offered for sale on the ARENAS by Helen Acosta Online Boutique are described and presented as accurately as possible (specifications, illustrations, size, composition, etc.). However, the Customer is recommended to refer to the description of each Product, by clicking on each “Product Description”, to find out more about the Product concerned, particularly in relation to the features the Customer is looking for, since the Customer is solely responsible for choosing and buying a Product.

PRICES

The prices applied are those indicated on the ARENAS by Helen Acosta Online Boutique at the time of the order.

The Customer is informed that prices are subject to change. Therefore, if the Customer has created a customer account, the prices displayed in the “My orders” section accessible from the “Log In/My Account” section on the order summary page correspond to the prices paid by the Customer for previous orders

Prices are indicated in EUR, and do not include the delivery costs of the order (hereafter “Delivery Costs”). These Delivery Costs are indicated to the Customer on the review cart page as well as on the order summary page, prior to confirmation and payment of the order.

TYPOGRAPHICAL ERRORS

Each item offered for sale on our website has an item description and/ or a reference link. You shall be responsible for confirming the information and content related to the item you wish to purchase through the information and/ or link provided before you submit any order. It is presumed that you have full knowledge and understanding of the details of the items you are purchasing upon submission of your order, as we shall not be liable for any after-sales issues resulting from misinterpretations of the related information and content on the website.

While ARENAS by Helen Acosta Ltd to provide accurate product and pricing information, pricing or typographical errors may occur. ARENAS by Helen Acosta Ltd cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, ARENAS by Helen Acosta Ltd shall have the right to refuse or cancel any orders placed for that item. In the event that an item is mis- priced, ARENAS by Helen Acosta Ltd may, either contact you for instructions or cancel your order and notify you of such cancellation.

COLORS

We have made every effort to display, as accurately as possible, the colors of our products that appear on the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

PACKING

Unless otherwise provided, we will comply only with its minimum packing standards for the method of transportation selected. The cost of all special packing, loading, or bracing requested by you will be paid for by you.

ARTICLE 2 ORDER

ORDER PROCESS

The Customer is invited to select the Products and to place them in the purchase cart by clicking on the “Add to cart” button. At any time, the Customer is invited to consult the summary of his order by clicking on the icon “See my cart” available on the top right of all ARENAS by Helen Acosta Online Boutique pages. At this stage, the Customer can verify the details of his order, identify eventual mistakes made in the entry of the data, and correct or remove Product(s).

After validation of the cart by clicking on the icon “Purchase”, the Customer is asked to choose between three (3) options:

Identifying himself with his Customer name and password to order by using his existing customer account,

ordering without creating a customer account,

ordering by creating a customer account.

ARENAS by Helen Acosta Ltd cannot be held liable for inaccuracy of the information provided by the Customer. The customer account will give access to a personal space where customers can track orders and access invoices.

To finalize his order, the Customer:

must confirm his delivery and invoicing address, or indicate a new delivery address and/or invoicing address,

select the delivery method from among those offered (delivery times and costs vary according to delivery method and are stated at this point),

check the summary of their order, and

must read these GTCs and explicitly accept them by ticking the box “I have read and accepted terms & conditions” before making payment for his order,

is then invited to pay the amount of the order by clicking on the icon “Place order” giving access to secure payment of the order.

The sale is only deemed complete after it is confirmed by ARENAS by Helen Acosta Ltd e- mailing the Customer confirmation of acceptance of the order at the e-mail address provided by the Customer, who formally accepts use of e-mail for ARENAS by Helen Acosta’s confirmation of the order.

ARENAS by Helen Acosta Ltd reserves the right to refuse to honour a Customer’s order if the order appears to be abnormal, excessive or in breach of the provisions of the GTC. Equally, ARENAS by Helen Acosta Ltd shall not be liable if the administrative and/or technical processing of an order on the Site is disrupted by a virus, computer bug, unauthorised human intervention or any other cause beyond the ARENAS by Helen Acosta’s control, or if there is a strong presumption of fraud, or in case of any form of fraud, committed in particular by computer, in which case ARENAS by Helen Acosta Ltd reserves the right to interrupt or cancel the outstanding order. In such cases, the Customer shall be informed by email of such cancellation of its order and will be reimbursed for the price paid before the order’s cancellation.

AVAILABILITY OF PRODUCTS

Products are offered within the limit of the stock available. Statements about the availability of the Products are provided at the time of the placing of the order on the Product page. If it turns out that despite the vigilance of ARENAS by Helen Acosta Ltd the Products ordered are no longer available, ARENAS by Helen Acosta Ltd informs the Customer by any means (telephone call or e-mail) as soon as possible. No debit corresponding to the unavailable Product or Products shall be made from the bank account of the Customer in the event of unavailability of one or several Products and in case that a payment from the Customer has been already processed, the Customer will be reimbursed for part of the payment corresponding to such unavailable Product(s).

PRE-ORDER

With the “Pre-order” option, Customers can order:

A Product that is not immediately available, but which can be delivered when it is back in stock

A Product from a new collection that can be purchased before it is even manufactured

When the “Pre-order” option is selected, the relevant Product is added to the Customer’s basket. With regard to the Product(s) that has/have been ordered as a “Pre-Order”, for information purposes, an estimated delivery date will be indicated in the Customer’s basket. ARENAS by Helen Acosta Ltd is not responsible for any delays on the dates provided.

The “Pre-order” Product order can be placed in conjunction with any other type of Product order. Standard delivery is the only possible delivery method for any Product(s) that is/are ordered using the “Pre-order” option.

When confirming the order, Customers are required to pay the total price indicated for all products ordered as a “Pre-order”. This payment constitutes an advance payment.

Customers will receive a confirmation email as soon as the order has been finalised.

In the event that ARENAS by Helen Acosta Ltd is not able to dispatch one or more “Pre-Order” Products within thirty (30) days following the estimated delivery date, the Customer may grant ARENAS by Helen Acosta Ltd a reasonable additional period of time in which to dispatch the Product(s). The Customer must inform ARENAS by Helen Acosta Ltd of this period in writing. If AREANS by Helen Acosta Ltd is unable to dispatch the Product(s) within the specified extension period, the Customer reserves the right to cancel the purchase of the corresponding Product(s) and request a refund.

Customers may cancel a “Pre-order” Product order at any time before the estimated delivery date by notifying ARENAS by Helen Acosta Ltd in writing.

CANCELLATION OF ORDER

Once the order is finalized, the Customer cannot modify his order. With or without the creation of a customer account, the Customer always has the possibility of making use of his right of withdrawal, the modalities of which are stipulated in Article 5 below.

ARTICLE 3 PAYMENT

The prices displayed on the Website for each Product are indicated in euros, depending on the country the Customer has chosen for shipping. Additional shipping fees may apply.

Prior to completion of any Order, Customers are provided with an overview of total cost, in the relevant currency, including the price of all the Products, applicable taxes and shipping costs and discounts, if any.

The amount of the Order may be settled using the payment methods available on the Website for the relevant country.

The Customer shall also bear all compulsory taxes and fees and potential bank charges which shall be born at all times by the Customer.

Customers completing an Order represent and warrant to ARENAS by Helen Acosta Ltd being entitled to use the payment instrument they use (e.g. credit card, or PayPal account or Apple Pay account).

ARENAS by Helen Acosta Ltd has established a secure payment system for any order made in the ARENAS by Helen Acosta Online Boutique. Payments with Paypal platform and Stripe.

Payment is deemed final after confirmation thereof is sent by the issuer. Should Paypal reject the payment, the order will be automatically refused and ARENAS by Helen Acosta Ltd will be released from any obligation and liability vis-à-vis the Customer.

The Customer has the possibility of downloading his invoice from his personal space under the heading “My Orders”.

In the event where the customer has not created a customer account, his invoice is available in the section “Follow my Order “accessible from the confirmation’s e-mail.

ARTICLE 4 DELIVERY AND RECEIPT OF PRODUCTS

TERMS OF DELIVERY

The ARENAS by Helen Acosta Online Boutique delivers to numerous countries, namely Metropolitan France, Corsica, Austria, Belgium Bulgaria, Croatia, Denmark, Estonia, Finland, Greece, Germany, Ireland, Italy, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal (except Madeira and the Azores), Romania, Slovakia, Slovenia, Spain (except Canary Islands, Ceuta and Melilla), Sweden, United Kingdom.

ARENAS by Helen Acosta Ltd delivers Products ordered at the delivery address indicated by the Customer (the “Delivery Address”) according to the delivery option selected by the Customer when placing his order. For detailed information regarding delivery options and costs, please consult the dedicated FAQ section in the footer of the ARENAS by Helen Acosta Online Boutique home page.

Information on delivery conditions are also available on the “See my cart” as well as checkout page, before the payment. No delivery will be made by ARENAS by Helen Acosta Ltd if the complete payment of the order is not possible.

Customers bear the consequences (late delivery, impossibility of delivery, Products returned to ARENAS by Helen Acosta Ltd, extra transport costs, etc.) resulting from any incorrect and/or incomplete delivery indications the Customer provided and/or the Customer’s absence at the time of delivery.

ARENAS by Helen Acosta Ltd shall do its best to dispatch the Products to the Customer as soon as possible after the Customer places his order, in accordance with the delivery option selected by the Customer when placing his order. Notwithstanding the above, in any event, delivery shall not exceed thirty (30) working days from receipt of the order confirmation, subject to their availability as indicated to the Customer at the time of the order. In the event of absence or delay in delivery, the Customer shall as soon as possible contact the Customer Service via the section “Contact us” section in the footer of the ARENAS by Helen Acosta Online Boutique home page. In case of late delivery, the Customer may either request ARENAS by Helen Acosta Ltd a new estimated delivery date or cancel the order and receive a full refund.

RECEIVING PRODUCTS

The risks attached to the Products are transferred to the Customer upon delivery, that is, when the Customer (or any third party named by the latter) physically takes possession of the Products concerned.

Upon delivery, the Customer must verify the conformity and the state of his order in the presence of the carrier and issue if needed be, all the necessary reservations concerning the apparent defects (missing product, damaged parcel). Moreover, it is up to the Customer (or any third party named by the latter) to check the number and condition of the Products when they are delivered by the carrier.

If the received parcel is open or obviously damaged, or if any of the Products in the parcel are damaged or missing or do not match the order, the Customer (or any third party named by the latter) should refuse the parcel or the Products concerned and make the customary written reservations, on

the carrier’s delivery note in as much detail as possible (parcel open, parcel or item(s) damaged or missing or not matching the order, etc.).

In any event, the Customer also undertakes to notify ARENAS by Helen Acosta Ltd forthwith via the section ” Contact us”, in order to allow ARENAS by Helen Acosta Ltd to investigate with the carrier and/or seek recourse from the carrier within the period specified by the applicable regulations, where appropriate.

If a Product is missing or is refused or returned by the Customer in the above circumstances, ARENAS by Helen Acosta Ltd will either refund the Product(s) concerned within 14 days or reship the damaged or missing Product(s).

It should be noted that the above provisions do not preclude the Customer’s right to withdrawal, as stated in Article 5 below, or the Customer’s benefit of the statutory warranties given, as stated in Article 8 below.

PRODUCT RETURN

The Customer benefits from a right of withdrawal allowing Products to be returned to ARENAS by Helen Acosta Ltd, with no reason given, under the conditions set out in Article 5 below.

For any other reason for return other than the right of withdrawal (non-compliant or damaged product, mistake in the content of the order, etc.), the Customer is invited to contact customer services of the ARENAS by Helen Acosta Online Boutique which will provide the necessary information to meet this request as soon as possible and to make another delivery if needed.

ARTICLE 5 RIGHT OF WITHDRAWAL & RETURN POLICY

RIGHT OF WITHDRAWAL

The Customer has the possibility, without justification, to withdraw his order within a period of fourteen (14) calendar days from the day of receipt of the Products ordered, with the date indicated on the receipt of the carrier signed by the Customer providing proof. When this period of fourteen (14) days expires on a Saturday, Sunday or a public holiday, it is extended to the next working day.

However, for health and hygiene protection, ARENAS by Helen Acosta Ltd cannot accept the return of all Products. Swimwear Products cannot be returned if they were worn by the Customer.

To exercise his right of withdrawal, the Customer can notify his withdrawal decision and return its Products as follows.

Either by directly returning the Product (following the process described hereafter) after having duly filled on www.arenasbyhelen.com the withdrawal form available in “My orders” section accessible from the “Log In/My Account” section on the order summary page on the section “My Account” ‘(being specified that the Customer is under no obligation to create a customer account).

Or by returning to ARENAS by Helen Acosta Ltd by e-mail an unambiguous declaration expressing the intention to retract. This declaration must be sent accompanied by the information concerning the articles and quantities returned as well as the name, postal address, order number and, if possible, the

telephone number and e-mail address of the Customer at the following address: shop@arenasbyhelen.com

To return Product(s), the Customer shall return, within a 14 days delay as from the date of notification of his/her decision to retract the Product(s). No return costs shall be reimbursed by ARENAS by Helen Acosta Ltd to the Customer.

Every Product must be returned new with all labelling in their original packaging. In the event of alteration of the Product resulting from handling other than that necessary to establish the nature and/or conformity of the Product, the characteristics or the proper functioning of the Product, ARENAS by Helen Acosta Ltd reserves the right to refuse the reimbursement or replacement of the Product. ARENAS by Helen Acosta Ltd shall not make any reimbursement if the Products returned by the Customer do not correspond to the Product(s) ordered or has an origin other than the ARENAS by Helen Acosta Online Boutique.

RETURN POLICY

The Customer has the possibility, to return one or several of its Product(s) of his order within a period of fourteen (14) calendar days from the day of receipt of the Product(s) ordered, with the date indicated on the receipt of the carrier signed by the Customer providing proof.

To return its Product(s), the Customer has to proceed as follows:

By directly returning the Product (following the process described hereafter) after having duly filled on www.arenasbyhelen.com, the return form available on “My orders” section accessible from the “Log In/My Account” section on the order summary page ‘(being specified that the Customer is under no obligation to create a customer account).

To return Product(s), the Customer shall return, within a 14 days delay as from the date of notification of his/her decision to return the Products

The cost of the return of products acquired on the ARENAS by Helen Acosta Ltd shall be paid by the Customer, regardless of the place of delivery of the goods.

Customers shall take all due care of the Products while in their possession. Customers are advised that ARENAS by Helen Acosta Ltd reserves the right to reject any returns, if Customers have breached such obligation of care, in particular, if the Products returned are damaged or show signs of use (i.e. broken seals, in particular for sun protection products, removed hygiene strips for women’s swimwear, dirt, etc.).

In such case, ARENAS by Helen Acosta Ltd will send the returned Products back to the Customer and not refund the price thereof.

Products cannot be returned any point of sale selling ARENAS by Helen Acosta’ Products.

REIMBURSEMENT OF THE ORDER

ARENAS by Helen Acosta Ltd shall reimburse the Products returned in accordance with the conditions stipulated in article 5.1 and 5.2 as well as the Delivery Costs paid by the Customer by a credit to the bank card or the online mean of payment which has been used to make the payment.

The reimbursement shall be made by ARENAS by Helen Acosta Ltd within a maximum period of fourteen (14) days following (i) the date of reception of the returned Product(s) by ARENAS by Helen Acosta Ltd or (ii) the date on which the Customer has provided the proof of the sending of the Products (with the date used being that of the first of these events).

ARTICLE 6 AFTER-SALES SERVICE

No claim will be considered, and no replacement of Products ordered in the ARENAS by Helen Acosta Online Boutique can be at a point of sale in which the Products bearing the ARENAS by Helen Acosta brand are sold.

ARTICLE 7 LIMITATION OF LIABILITY

ARENAS by Helen Acosta Ltd cannot be held liable for the breach of one of its obligations if the poor performance of the contract is the result of(i) any factor beyond our reasonable control, including but not limited to: fire, act of God, storm, explosion, earthquake, flood, tempest, accident, pandemic or other natural disaster; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock outs, blockdown or other industrial actions or trade disputes; difficulties in obtaining raw materials, labour, fuel, parts or machinery faced by us or suppliers; or telecommunication, transportation, power supply, or system disturbances or failures, or breakdown,(ii)or by the Customer’s act or omission or of an unforeseeable and insurmountable act of a third party or an obstacle outside of ARENAS by Helen Acosta’ control that ARENAS by Helen Acosta Ltd could not reasonably foresee at the time when the contract was entered into with the Customer and which consequences ARENAS by Helen Acosta Ltd cannot reasonably avoid or overcome.

ARTICLE 8 PRODUCT WARRANTY

ARENAS by Helen Acosta Ltd warrants that the Products are according to the relevant Product Sheet, free from defects and fit for the designated purpose.

Should any Product delivered by ARENAS by Helen Acosta Ltd not comply with the warranty according to Article 8.1 above, and subject to article 8.3, Customers may return such Product and ARENAS by Helen Acosta Ltd shall at its own cost and at the Customers’ choice:

either deliver an identical replacement Product, subject to availability;

deliver a Product of equivalent quality and price, subject to availability; or

reimburse all payments received from the concerned Clients for the Products returned in accordance with Article 9, including transportation charges corresponding to the least expensive method of shipment available on the Website, within thirty (30) days of the request.

Customers who intend to claim any rights under warranty shall first contact ARENAS by Helen Acosta Ltd at the address indicated in Article 9 before returning any Products.

ARENAS by Helen Acosta Ltd reserves the right to assess the grounds for warranty before and after any return and Customers shall fully cooperate with ARENAS by Helen Acosta Ltd for the purposes of such assessment before returning any Products (i.e. provide any information that might be requested by AREANAS by Helen Acosta Ltd , including photos of possible defects).

Products that have been altered and/or damaged by Customers or that have been used in a way that does not comply with their designated purpose or use, in accordance with the instructions and directions for use provided by ARENAS by Helen Acosta Ltd, will be excluded from any and all warranties.

In such case, ARENAS by Helen Acosta Ltd will send the returned Products back to the Customer and not refund the price thereof.

Subject to mandatory provisions of applicable law, the Customers’ remedies under Article 8.2 represent ARENAS by Helen Acosta’ exclusive liability to the Customers, with respect to the Products.

The Customer is also informed of the existence of the statutory warranty of conformity of goods in the country of his/her habitual subject to national conditions.

ARTICLE 9 EXCLUSION OF WARRANTY

If the Products returned by the Customer do not correspond to the Products ordered or originate from somewhere other than the ARENAS by Helen Acosta Online Boutique, ARENAS by Helen Acosta Ltd will not be bound by its obligations described in Articles 8.1 above.

It should be noted that statutory warranties do not cover damage or defects resulting from an external cause (accident, knock, etc.) or from the Customer’s misuse, or non-conform use of the Products with regards of Products characteristics.

Equally, this clause does not apply if the Products were not purchased on the Site, as statutory warranties are binding on the seller from which the Products were purchased.

ARTICLE 11 GOVERNING LAW/DISPUTES

These GTCs and any order made through the ARENAS by Helen Acosta Online Boutique are governed by Maltese law barring legal provisions to the contrary imposing the applicability of a foreign law. However, application of the laws of Malta cannot result in depriving the Customer of the level of protection provided by provisions of mandatory laws of the country of his habitual residence.

In the event of dispute concerning the ARENAS by Helen Acosta Online Boutique, these GTCs and/or an order, ARENAS by Helen Acosta Ltd invites the Customer to contact the ARENAS by Helen Acosta Online Boutique Customer Services at the number indicated in the “Contact us” section in the footer of the ARENAS by Helen Acosta Online Boutique home page in order to refer its claim of dispute and try to find an amicable solution with ARENAS by Helen Acosta Ltd.
